Speed measurement with TraffiStar S350 laser scanner: Statement on the verdict of the Saarland Constitutional Court

On the occasion of a judgement in Saarland, Germany we inform about our TraffiStar S350 laser speedometer.

On July 9, 2019 the Saarland Constitutional Court published its ruling of July 5, 2019 on a constitutional complaint in connection with a speed violation and on the question of measurement data stored by the JenoptikTraffiStar S350 measuring device in the case of speed offences.

We do not think the verdict is right. It sends a negative signal as regards road traffic safety in Germany.

The measurement technology works reliably and correctly. Our TraffiStar S350 measuring device fulfils all existing legal regulations for measuring instruments subject to legal verification according to the Measuring and Verification Act (MessEG) as well as the Measuring and Verification Ordinance.

The approval for the measuring instrument by the Physikalisch-Technische Bundesanstalt (PTB, the German metrology standards body) is not revoked by the judgement. Neither does the Constitutional Court question the fact that speed measurement with TraffiStar S350 is a standardized measurement method and functions technically flawlessly. In addition, the ruling only applies in the federal state of Saarland. From our point of view, there is no reason to shut down the devices in other federal states.

Higher Regional Courts explicitly denied the question of the necessity of storing raw measurement data several times.

Irrespective of this, we want to continue to support the operators of the measuring stations in their work for road traffic safety. Therefore, we will present a software amendment to PTB in July, which will address the points of criticism from the judgement on so-called raw measurement data. We are in close coordination with PTB for this purpose and hope for a speedy confirmation. A completely new approval of the measuring instrument is not necessary.
